South Africa to Submit Dossier on Israels Genocide Against Palestinians at ICJ

South Africa’s legal team is set to present evidence, facts, and arguments in a memorial before the International Court of Justice, ICJ, on Monday to prove its case that Israel is committing genocide against the State of Palestine.

South Africa’s latest move, as announced in September, followed a series of legal battles it started on December 29, 2023, and presented to the ICJ on January 11, 2024, after the Hamas attack on October 7, 2023, against Israel, which, in turn, led to Israel killing over 42,000 Palestinians, including women and children.

Subsequently, on January 26, 2024, the ICJ ruled in favour of South Africa’s case, which, by provisional measures, requested the World Court to order Israel to suspend its military operation in or against Gaza and for hostage negotiation to be considered pending the court’s final decision.

The ICJ, amongst several rulings, found SA’s case plausible, and it was to prove its case, hence the recent move to submit a dossier (or memorial) containing facts, evidence, and arguments to prove Israel is committing genocide in Palestine.

With Israel’s refusal to follow many of the court’s orders (including the ceasefire plea) and continued its attacks on Palestine in violation of the 1948 Genocide Convention, South Africa has filed the memorial, and Israel is expected to file a counter-memorial on or before July 28, 2025.

Meanwhile, as the death toll in Palestine increases by Israel Defense Forces (IDF) under Prime Minister Benjamin Netanyahu, United Nations Secretary-General Antonio Guterres said he is “shocked by harrowing levels of death, injury and destruction” in north Gaza.

It is also worth noting that the United States, under the outgoing President Joe Biden and his Vice, now Presidential Candidate Kamala Harris, vetoed the UN resolution, which called for humanitarian pauses in the war. The US has also funded Israel with $17.9 billion in military aid since October 7, 2023, while chanting, “Israel has a right to defence itself,” as the UK, France, Germany, Australia, European Union, NATO, and Canada widely regurgitate it.
