Justice Binta Nyako of the Federal High Court in Abuja has recused herself from the trial of Nnamdi Kanu of the Indigenous People of Biafra (IPOB).
Justice Nyako stepped down from the case on Kanu’s request. The federal government is trying Kanu on seven counts of charges bordering on terrorism.
Kanu made the request in open court on the basis that the judge refused to obey a judgment of the Supreme Court.
I can understand it if the DSS refuse to obey a court order, but for this court to refuse to obey an order of the Supreme Court is regrettable.
I am asking you to recuse yourself from this case, the secessionist demanded.
Kanu, who ordered his lawyer to sit down, argued that the Supreme Court had ruled against his continued detention. However, the judge agreed with the prosecuting counsel that Kanu’s interpretation of the apex court’s judgement was wrong.
Justice Nyako replied that she would be happy to grant the request to recuse herself, saying she would be sending Kanu’s case file back to the Chief judge for reassignment to another judge.
I hereby recuse myself and remit the case file back to the Chief Judge, she declared.
Recall that Justice Nyako denied multiple bail applications by Kanu and threatened to hold him and his counsels in contempt if they filed any more bail application
