Emefiele’s Detention Lawful, EFCC to appeal against N100m fine

Judge orders FG to pay Emefiele $100,000 (100,000,000) for illegal detention. Court rules rights of liberty were violated by DSS & EFCC.

Following the recent verdict of the Federal High Court, Abuja, the Economic and Financial Crimes Commission has expressed its dissatisfaction over the judgment of the Federal Capital Territory High Court awarding N100 million damages against it in favour of Godwin Emefiele, the former governor of the Central Bank of Nigeria. EFCC says it will appeal against the N100m fine.

Recall reports that on Monday, 8 January 2024, Justice O.A. Adeniyi, fined the EFCC after ruling that the commission’s detention of Emefiele during its investigation violated his right to liberty.

Reacting to the verdict in a statement on Monday, the EFCC announced its plans to appeal it in the Court of Appeal,  emphasizing that the judge failed to recognize that the commission detained the former CBN governor under a valid court order.

EFCC’s words precisely, “the decision failed to take cognizance of the fact that the former CBN Governor was held with a valid order of court. Consequently, the commission will approach the Court of Appeal to set it aside.”
