Court Denies Davido’s Stay of Proceedings in N2 Billion Lawsuit Over ‘Warri Again Concert’

A Delta State High Court sitting in Effurun has dismissed Nigerian music star Davido’s application for a stay of proceedings in the N2 billion lawsuit filed against him by Brownhill Investment Company Limited over the annual ‘Warri Again Concert.’

According to court documents obtained, the company alleged that Davido had previously disappointed them on two occasions, leading its chairman, Amaju Pinnick, to be hesitant in granting him the contract despite Davido’s special request to perform at the event.

The company claimed that Davido signed all the necessary agreement papers demanding full payment but later reneged on the agreement by performing at another event in Australia on the same date.

In November 2023, SaharaReporters reported that Brownhill Investment Company Limited was seeking N2 billion in general damages from Davido and his music company, Davido Music Worldwide Limited, along with additional sums for legal expenses and the cost of filing the lawsuit.

During the recent court hearing, Davido’s counsel informed the court of a pending appeal and a motion for a stay of proceedings. However, the counsel later moved to withdraw the application, citing the Court of Appeal’s jurisdiction over the matter.

The claimant’s counsel did not contest the withdrawal, and the court granted the motion accordingly. The court also ruled that proceedings would continue until an order for a stay of further proceedings is obtained from the Court of Appeal.

Additionally, the court granted a motion seeking to regularize the claimant’s reply to the statement of defence and directed the filing of Pre-Trial Conference (PTC) forms within 14 days, setting the next hearing for March 21, 2024.
